What changed after the NAR settlement

On August 17, 2024, NAR practice changes took effect for Realtor MLSs.
MLS platforms stopped publishing offers of compensation from sellers or listing brokers to buyer brokers.
Compensation can still be negotiated off the MLS.
Sellers can still agree to contribute toward a buyer broker fee.
They just cannot advertise that offer inside the MLS feed the way many buyers remember.
Written buyer agreements became a nationwide requirement for many Realtor professionals before touring homes with them.
NAR’s consumer guide is plain on this.
Compensation between you and your real estate professional is negotiable and not set by law.
The amount in the agreement must be clearly defined.
A flat fee, a percent, an hourly rate, or even zero if that is what you both agree to.
Not a range.
Not “whatever the seller offers.”
Open houses you walk alone, or a quick chat about services, do not require that paper first.
Once you want that agent to tour homes with you, the written agreement comes first.
What Indiana already required

Indiana did not wait on the settlement alone.
House Enrolled Act 1068, effective July 1, 2024, requires Indiana-licensed brokers to have written representation agreements with buyer clients and seller clients.
The agreement must be in writing, paper or electronic.
It must show a definitive expiration date.
The broker keeps the original and gives you a copy within three business days of signing.
That is state law through the Indiana Professional Licensing Agency and the Indiana Real Estate Commission.
It sits next to the NAR touring rule, not instead of it.
If you buy in Illinois with us, we still put the relationship and pay terms in writing before the work gets serious.
State forms differ.
Clarity does not.
So do buyers pay now
Under the buyer agreement, you are responsible for paying your buyer broker as the paper says.
That is the honest starting point.
You can still ask the seller to cover all or part of that amount in the purchase offer.
Just like closing-cost help.
Just like a repair credit.
The request lives in the deal, not as a hidden MLS field.
Sometimes the seller says yes.
Sometimes they counter a lower amount.
Sometimes they say no and your cash, loan, and agreement terms decide the next move.
